This document outlines FCEI Limited’s (“FCEI”) approach to Data Privacy to fulfil our obligations under the General Data Protection Regulation 2018 (“GDPR”). Your Rights

Under GDPR you have the right to:

  • access the personal data we hold on you;
  • correct and update the personal data we hold on you;
  • have your personal data erased;
  • object to processing of your personal data;
  • data portability;
  • withdraw your consent to the processing of personal data for which consent was sought;
  • object to the processing of personal data where applicable; and
  • complain to the Data Protection Commissioner

We are obliged to respond to you without undue delay. In most instances, we will respond within one calendar month. If we are unable to deal with your request fully within a calendar month (due to the complexity or number of requests), we may extend this period by a further two calendar months. Should this be necessary, we will explain the reasons why. If you make your request electronically, we will, where possible, provide the relevant information electronically unless you ask us otherwise.

The information we collect about you

We need to collect information on you for a number of reasons e.g. we need to know how to contact you in relation to the services you have or wish to use and we have an obligation to be certain of your identity.

We collect the following Identity and contact information:

  • name, date of birth, copies of ID, contact details, address details, PPS number (or foreign equivalent), nationality, email address, work and personal phone number, source of funds and purpose of transaction.

We also hold image recordings from CCTV at our branches. This is used only for security reasons and to help prevent fraud and/or crime.

When we collect information about you

We collect information from you as you use our services or make enquiries as follows:

  • when you ask us to provide you with services;
  • when you give us information verbally or in writing; and
  • publicly available information about you through internet searches to verify identity.

How we use your information

We use your information to:

  • provide our services to you;
  • manage our business for legitimate interests;
  • comply with our legal and regulatory obligations e.g. establishment of your identity and source and purpose of funds. In this regard, we may be required to disclose your information to government and other statutory bodies to comply with anti-money laundering, fraud and terrorist financing regulations. We also need to comply with binding requests from the Central Bank of Ireland (or its successor) or with orders from other law enforcement agencies.

You can choose not to share your information with us but it may limit the services we are able to provide to you.

Who we share your information with

We only share your information when strictly necessary and only share it with statutory and regulatory bodies and law enforcement agencies.

How long we hold your information

The length of time we hold your data depends on a number of factors, such as regulatory rules and the service we have provided to you. Those factors include:

  • the regulatory rules contained in laws and regulations or set by authorities like the Central Bank of Ireland, for example, in the Consumer Protection Code;
  • the type of service we have provided to you;
  • whether you and us are in a legal or some other type of dispute with another person or each other;
  • the type of data we hold about you;
  • whether you or a regulatory authority asks us to keep it for a valid reason.

As a general rule, we keep your information for a specified period after the date on which a transaction has completed or you cease to be a customer. In most cases this period is seven (7) years.

Processing your information outside the EEA

Your information is stored on secure systems within our premises and with providers of secure information storage. All of our service providers comply with EU data protection laws.

Updates and Amendments

FCEI reserves the right to modify or amend this statement from time to time. The effective date will be displayed at the start of the notice.
